Interpretation of the Management Guidelines on Staff Management of Overseas Chinese-funded Enterprises

     In recent years, Chinese enterprises have accelerated the process and expanded the areas of ¡°Going Global¡±, and the number of overseas Chinese-funded enterprises (organizations) has been increasing. The proportion of local employees is increasing in overseas Chinese-funded enterprises, which have made great contribution to creating employment opportunities, and improving people¡¯s wellbeing in host countries. According to the statistics, the number of employees in overseas Chinese enterprises (organizations) amounted to 970,000 by the end of 2009, of which 438,000 were foreigners.

However, some of the Chinese enterprises have encountered disputes and frictions with their employees due to the lack of experience and inadequate knowledge of laws and regulations of the host countries, which have affected the normal business operation and the sustainable development of China¡¯s outward investment and cooperation. With respect to that, the Ministry of Commerce, the Ministry of Foreign Affairs, the State-owned Assets Supervision and Administration Commission of the State Council and All China Federation of Industry and Commerce jointly issued the Management Guidelines on Staff Management of Overseas Chinese-funded Enterprises (the Guidelines) to strengthen guidance for multinational enterprises.

The Guidelines, covering personnel selection and training, overseas employment and handling of overseas labor disputes, is one of the measures implemented by the authorities including the Ministry of Commerce to strengthen macro-guidance and services for the ¡°Going Global¡± strategy of Chinese enterprises. As a non-mandatory document, it can guide Chinese enterprises in overseas staff management, help establish a harmonious labor relations and a favorable external environment for the ¡°Going Global¡± strategy so as to achieve the sustainable development of China¡¯s outward investment and cooperation. It will also help Chinese enterprises to better integrate into the local communities, and achieve mutual benefits and win-win for the common development.
